Important Notes on Schedule

  • Prevailing Wage determination by DOL must be valid at the time of filing ETA 9089 or at least 1 stop on the Recruitment line must be visited during the Prevailing Wage determination validity period.
  • Recruitment line travel and Compliance Documentation must be completed less than 180 days prior to filing ETA 9089. The earliest Recruitment line stop cannot be more than 180 days prior to filing of ETA 9089.
  • Internal Posting and Job Order must be completed at least 30 days prior to filing of ETA 9089.
  • Both Major Newspaper ads stops for Professionals and Non-Professionals lines must be made at least 30 days prior to filing of ETA 9089.
  • Only 1 out of 3 additional recruitment stops for Professionals line can be less than 30 days prior to filing of ETA 9089.
  • ETA 9089 appeal with CO must be filed within 30 days of denial notification.
  • ETA 9089 audited response must be filed within 30 days of audit notification.
  • ETA 9089 for college/university professors must be filed within 18 months of the foreign worker's selection.
  • Immigrant Visa Petition with USCIS must be filed within 180 days of ETA 9089 certification date.
